Terms of Service

1. Introduction

Welcome to Quill Wars ("we," "us," "the Service"), a literary text generation tool that produces prose in the voice of historical and canonical literary authors. By creating an account, purchasing credits, or otherwise using the Service, you ("you") agree to these Terms of Service ("Terms").

If you do not agree to these Terms, do not use the Service.

These Terms form a binding legal agreement between you and Quill Wars. Read them carefully.

2. Eligibility

To use Quill Wars, you must:

  • Be at least eighteen (18) years of age. The Service is not intended for minors and you may not create an account if you are under 18.
  • Have the legal capacity to enter into binding contracts in your jurisdiction.
  • Not be barred from using the Service under any applicable law, including export restrictions and sanctions.
  • Be responsible for ensuring that your use of the Service complies with the laws of your jurisdiction. The Service is not available where its use would violate local law.

If we have reason to believe you do not meet these eligibility requirements, we may suspend or terminate your account.

3. Account Registration

To use Quill Wars you must create an account. You agree to:

  • Provide accurate and current information.
  • Confirm your date of birth at registration.
  • Keep your login credentials confidential.
  • Notify us immediately of any unauthorized use of your account.
  • Be responsible for all activity that occurs under your account.

We reserve the right to refuse registration, suspend accounts, or terminate accounts at our discretion, particularly in response to violations of these Terms.

4. Credits and Payment

Quill Wars uses a pay-per-use credit model. There are no subscriptions or recurring charges.

4.1 Free baseline

The Default voice is free to use without limit for all account holders, including unpaid accounts. Generations with the Default voice do not consume credits.

4.2 Author voice access

All author voices (Jane Austen, James Joyce, Mark Twain, and others) are available to every account holder. There is no subscription or separate unlock; an author voice is used simply by spending credits as described below.

4.3 Credit-based usage

The following actions consume credits:

  • Each new prompt submitted for generation with an author voice costs one (1) credit.
  • The first Continue extension on any single prompt is free.
  • Continue extensions two and beyond on the same prompt cost one (1) credit each.
  • Side-by-side comparison generations cost one (1) credit per voice generated.
  • Each practice Judge (scoring one piece against the rubric) costs one (1) credit.
  • Each generation produces up to 200 tokens of output (approximately 150 words).
  • Generations blocked by the content filter or that produce hard errors do not consume credits.

4.4 Credit packs

Credits are purchased in packs:

  • 30 credits for $1.99 (starter)
  • 100 credits for $5.00
  • 500 credits for $20.00
  • 1000 credits for $35.00

Pricing is subject to change with notice. Changes do not affect credits already purchased.

4.5 Signup gift

New accounts receive ten (10) free credits at registration.

4.6 Credit rollover

All credits, whether purchased or gifted at signup, do not expire while the account is in good standing.

4.7 Auto-refill

You may opt in to automatic credit refills tied to a stored payment method. When your credit balance falls below a threshold you set, your card is automatically charged for your selected credit pack. You may disable auto-refill at any time in your account settings.

4.8 Payment processing

All payments are processed through third-party payment processors. By providing payment information, you authorize us and our processors to charge your selected payment method. You are responsible for all applicable taxes.

4.9 Refunds

Credits are non-refundable except (a) where required by consumer protection law or (b) at our discretion. Unused credits are forfeit on account termination for cause. On voluntary cancellation, you have 30 days to use remaining credits before account deactivation.

5. Acceptable Use

You agree not to use Quill Wars to generate, request, or attempt to generate any of the following:

5.1 Prohibited content

  • Content sexualizing minors. You will not attempt to generate sexual content involving any minor, whether fictional or real. This includes, without limitation, prompts that combine sexual setup language with canonical child characters such as Huckleberry Finn, Tom Sawyer, Oliver Twist, the March sisters in their pre-adult chapters, David Copperfield as a child, Pip as a child, or Tiny Tim. The listed characters are illustrative examples only and do not limit this prohibition.
  • Real living people in sexual or violent scenarios. You will not use the Service to generate sexual content, violent content, or content depicting illegal acts involving any identifiable real living person.
  • Non-consensual scenarios. You will not use the Service to generate sexual content depicting non-consensual acts or coercion involving any party.
  • Illegal content under your local law. You will not use the Service to generate content that is illegal to possess or distribute under the laws of your jurisdiction.
  • Content intended to harm. You will not use generated content to harass, defame, threaten, blackmail, or impersonate any person.

5.2 Acknowledgment

You acknowledge that Quill Wars employs both automated content filtering and account-level monitoring. Violations of the Prohibited Content provisions may result in immediate account suspension, forfeiture of credit balance, reporting to law enforcement where required by law, and permanent ban from the Service.

6. Voice Authenticity Disclaimer

Quill Wars reproduces the voices of literary authors based on their actual written work. This includes their actual writing styles, vocabularies, and worldviews as expressed in their work, some of which reflect attitudes from the historical periods in which the authors lived.

Generated content may include:

  • Religious and moral frameworks (including condemnation of behaviors considered sinful by the author).
  • Period-typical phonetic dialect rendering of speech, including dialect representations of marginalized groups that modern readers may find offensive.
  • Gender norms, colonial-era worldviews, racial framings, and class assumptions that have not aged well by contemporary standards.

Quill Wars does not endorse these views. We reproduce them because authentic literary reproduction is the value the Service offers. If you are not comfortable receiving output that reflects the actual worldviews of 19th- and early-20th-century literary authors, the Service is not for you.

7. Intellectual Property

7.1 The Service

The Service, its underlying models, the trained voice adapters, the interface, and all related software are the intellectual property of Quill Wars (or its licensors). You receive a limited, non-exclusive, non-transferable license to use the Service for personal or professional creative purposes.

7.2 Content you create

You retain ownership of the content you create through the Service, including the prompts you submit, the text the Service generates, and any edited versions you produce within the Service, to the extent such content is capable of ownership under applicable law.

You grant Quill Wars a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, store, reproduce, modify, adapt, publish, and create derivative works from that content in order to operate, improve, and develop the Service and to train, evaluate, and improve our models. This license survives the deletion of your content or the termination of your account.

You may use the text you generate via the Service for personal and commercial purposes, including creative writing, drafting, editing, research, and teaching.

You understand that:

  • AI-generated text generally cannot be copyrighted under current US law due to lack of human authorship. You may use it freely but you do not necessarily own it in the traditional copyright sense.
  • Generated text may resemble passages from existing literary works given the nature of the training material. You are responsible for ensuring any commercial use does not infringe third-party copyrights.
  • Quill Wars does not warrant the originality of any generated text.

7.3 Training material

The literary voice adapters were trained on published works by their respective authors, the majority of which are in the public domain. Quill Wars believes its use of training materials is authorized by applicable law and/or license.

7.4 Copyright complaints

We respect the intellectual property rights of others. If you believe that material available through the Service infringes a copyright you own or control, send a written notice to support@quillwars.com that includes: (a) your contact information; (b) identification of the copyrighted work you claim has been infringed; (c) identification of the material you claim is infringing and where it is located within the Service; (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (e) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on its behalf; and (f) your physical or electronic signature. We will respond to valid notices as required by applicable law and may remove material or terminate accounts of repeat infringers.

8. Privacy and Data

We collect and process personal information as described in our Privacy Policy. By using the Service, you consent to this processing.

We log all prompts submitted and all text generated, associated with your account. These logs are retained for purposes of:

  • Service operation, development, and improvement, and potential model training and evaluation.
  • Investigation and response to acceptable-use violations.
  • Compliance with legal obligations.
  • Customer support.

We do not sell your personal information or your generated content, we do not use your content for advertising, and we do not sell access to your content to third parties.

Do not submit confidential, proprietary, trade-secret, attorney-client privileged, medical, or other highly sensitive information to the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that generated content will meet your expectations or be suitable for any particular purpose.

Generated content may be inaccurate, offensive, misleading, historically inaccurate, or factually wrong. The Service produces literary text for creative purposes and should not be relied upon as a source of factual information.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUILL WARS AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

Our total cumulative liability arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless Quill Wars and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Service.
  • Your violation of these Terms.
  • Your violation of any applicable law or third-party right.
  • Any content you submit or generate via the Service.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination:

  • Your access to the Service ends.
  • If we terminate your account for cause (for example, for violation of these Terms), your remaining credit balance is forfeited.
  • If we terminate or suspend your account without cause, we will refund the value of your unused purchased credits. Credits received free at signup or by gift are not refundable.
  • These Terms continue to apply to past use of the Service.

You may terminate your account at any time by contacting us. Because there are no subscriptions, there is no recurring billing to cancel; any remaining credit balance is handled as described in Section 4.

13. Modifications

We may modify these Terms at any time. Material changes will be communicated to you via email or in-product notification at least thirty (30) days before they take effect. Continued use of the Service after the effective date of changes constitutes acceptance of the modified Terms.

14. Governing Law and Disputes

14.1 Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of laws principles.

14.2 Binding arbitration

Except as provided in Section 14.4, you and Quill Wars agree to resolve any dispute arising out of or relating to these Terms or the Service through final and binding individual arbitration, rather than in court. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration may be conducted by telephone, online, or in writing, or, if the arbitrator determines a hearing is appropriate, in the county where you live or another mutually agreed location. The arbitrator's decision may be entered as a judgment in any court of competent jurisdiction.

14.3 Class action waiver

You and Quill Wars agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of a representative or class proceeding.

14.4 Exceptions and small claims

Either party may bring an individual claim in small claims court if it qualifies. Either party may also seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information. For any dispute not subject to arbitration, the state and federal courts located in Boulder County, Colorado, shall have exclusive jurisdiction, and you consent to the personal jurisdiction of those courts.

14.5 Your right to opt out

You may opt out of the arbitration and class action waiver provisions in Sections 14.2 and 14.3 by sending written notice to support@quillwars.com within thirty (30) days of first accepting these Terms. Your notice must include your name and the email associated with your account. If you opt out, the court provisions of Section 14.4 (Boulder County, Colorado) apply instead. Opting out does not affect any other provision of these Terms.

15. Miscellaneous

  • Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Quill Wars regarding the Service.
  • Severability. If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force.
  • No waiver. Our failure to enforce any right or provision is not a waiver of that right.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms freely in connection with a merger, acquisition, or sale of assets.
